The next comment period for the Proposed Part 360 Regulations is underway!

One June 21, 2017, the NYSDEC released a revised version of the Proposed Part 360 Regulations, which can be found at the following link: http://www.dec.ny.gov/regulations/81768.html

This proposed rulemaking is a comprehensive revision to existing regulations. The proposed regulations were originally published for public comment in 2016. Due to public comments received, significant changes were made to some of the regulatory criteria which resulted in a revised version of the proposed regulations. The revised version has been provided in a tracked changed format to highlight the changes. In support of these regulatory changes a Draft Generic Environmental Impact Statement (DGEIS) has been prepared. The revisions include technical amendments and clarifications, as well as updated criteria needed due to legal and policy developments.

A public hearing regarding the revised proposed regulations and revised DGEIS will be held on July 13, 2017, 1:00 PM: NYSDEC, 625 Broadway, Albany, NY 12233.

Written comments on these draft regulations and DGEIS will be accepted until 5:00 p.m. on July 21, 2017. The NYSDEC is asking that comments be submitted on the Revised Part 360 Comment Form. Comments must be submitted to: SolidWasteRegulations@dec.ny.gov or to:

If there is no extension granted to the public comment period, the regulations will most likely go into effect in November, 2017.
